Drug-Driving Investigations: The Role of Forensic Toxicology and Evidential Challenges

Evidential Blood Specimens

The prosecution's case will ordinarily depend upon laboratory analysis of an evidential blood specimen obtained after arrest.

The taking, handling, storage, transportation, and analysis of blood samples are governed by strict statutory procedures designed to preserve the integrity of the evidence. Maintaining continuity throughout this process is essential. Any break in the chain of custody or departure from the prescribed procedures may affect the reliability of the prosecution's evidence.

Issues capable of arising include:

  • delays between the alleged driving and the taking of the specimen
  • continuity and chain of custody

The Statutory Medical Defence

Section 5A also provides a limited statutory medical defence for motorists who have consumed certain specified drugs in accordance with medical or dental directions.

The availability of the defence will depend upon the individual circumstances of the case. A defendant must ordinarily demonstrate that the drug was prescribed or supplied for legitimate medical purposes and that it was taken in accordance with the directions provided by the prescribing clinician or accompanying instructions.

The increasing availability of cannabis-based medicinal products has brought renewed attention to this defence. While lawful prescription may provide protection in appropriate cases, it does not create complete immunity from prosecution. Questions concerning dosage, compliance with medical advice, and the surrounding factual circumstances frequently require detailed examination.

Disclosure and Procedural Challenges

As in all criminal investigations, disclosure obligations remain fundamental.

Under the Criminal Procedure and Investigations Act 1996, the prosecution is under a continuing duty to disclose material capable of undermining its case or assisting the defence.

In drug-driving investigations, defence representatives may seek disclosure of:

  • roadside screening device approval and maintenance records
  • calibration and quality assurance documentation
  • laboratory accreditation and validation procedures
  • toxicology reports together with underlying analytical data
  • chain of custody documentation
  • officers' notebooks and investigation records
  • forensic continuity documentation.

Proper disclosure enables the defence to assess the reliability of the scientific evidence and identify any procedural irregularities capable of affecting either admissibility or evidential weight.

Evidential and Procedural Issues

While section 5A prosecutions are often described as "strict limit" cases, they remain subject to the ordinary safeguards governing criminal proceedings.

Questions may arise concerning the lawfulness of the arrest, compliance with statutory procedures governing evidential specimens, continuity of evidence, the reliability of laboratory analysis, and the admissibility of expert evidence.

Where significant procedural failures have occurred, the defence may seek to challenge the admissibility of evidence or argue that deficiencies in the investigation undermine the prosecution's ability to prove the offence beyond a reasonable doubt.

Advances in forensic science continue to influence the investigation and prosecution of drug-driving offences. Improvements in toxicological analysis permit increasingly accurate detection of controlled substances at extremely low concentrations, while developments in medicinal cannabis prescribing continue to raise novel legal and evidential questions.

As scientific techniques become more sophisticated, the successful prosecution and defence of drug-driving allegations will increasingly depend upon a detailed understanding of forensic evidence, statutory safeguards, and expert interpretation.
